CliNB, Judge:

This is a suit against the United States in which the plaintiff seeks to recover additional duty assessed by the collector at the rate of 10 per centum ad valorem under section 304 (b) of the Tariff Act of 1930 on the ground that the merchandise was not legally marked at the time of importation.

The record shows that the imported merchandise consists of hops which were grown in Czechoslovakia and were packed in-Germany and shipped from that country on December 31, 1936, which is prior to the date when Germany assumed control over any portion of Czechoslovakia. At the time of…
