MEMORANDUM OF DECISION

CURRAN, District Judge.

First Bank Southeast of Kenosha, Wisconsin, as personal representative of the estate of Stanislaus Wojtyn 1 commenced this wrongful death action against the M/V Kalidas and the Shipping Corporation of India, Ltd. (the “ship defendants”) 2 alleging that Wojtyn’s drowning death “was exclusively caused by the careless and negligent conduct of the ship’s crew in failing to keep said vessel’s lines from snapping.” See Complaint at If 11.
