Proceeding pursuant to CPLR article 78 (transferred to this court by order of the Supreme Court at Special Term, entered in Albany County) to review a determination of the State Comptroller which denied petitioner’s application for accidental disability retirement. Petitioner, while employed by the Town of Islip Highway Department as an automotive equipment operator, allegedly injured his back on February 21, 1973 when he was struck by a sand spreader causing him to fall from a truck he was working on.
