HICKMAN, Commissioner.

This suit was brought by defendant in error, Eugene W. Hays, to annul an order of the board of directors of plaintiff in error, Zavala-Dimmit Counties Water Improvement District No. 1, dated November 30, 1925, annexing lands owned by Hays to said district and to remove cloud from his title to such lands created by such order. The relief prayed for was granted by the trial court and its judgment was affirmed by the Court of Civil Appeals, 198 S.W.2d 535.

The application of Hays to have his lands annexed to the district was made under the provisions of Article 7649,…
