-Appeal from Yates county court. Action by Baldwin’s Bank of Penn Tan against John H. Butler, impleaded with others. Prom an order granting a new trial to the defendant Butler, plaintiff appeals.

This action was brought to recover upon two notes, respectively, of $1,000 and of $500, against Wood, Butler & Morris, a firm of lawyers doing business in Penn Tan. The $1,000 note, which was dated the 28th day of February, 1883, has no place in this appeal, inasmuch as the court at the trial nonsuited the plaintiff in respect to it, and submitted only to the jury the question of the defendants’ liability upon the $500 note.
