McBRIDE, Judge.

On the night of September 6, 1949 Can-dido Lopez sustained injuries from which he died as a result of being struck by an automobile owned and operated by Frank Gal-lardo on the State Highway which connects Delacroix Island in St. Bernard Parish with the City of New Orleans. The road is about 20 feet in width. Lopez was attempting a foot-crossing of the highway from the bayou side thereof to the gate of his front yard. Although the petition alleges that the accident occurred at approximately 8 o’clock p. m., the weight of the evidence is that the time was between 9 and 9:30…
