This is a motion to vacate an attachment issued on the ground that the defendant “ has departed from this State to England with intent to defraud his creditors or to avoid the service of a summons in this action ”. It appears by affidavit that an indebtedness exists in plaintiff’s favor in the sum of $753.75, the balance due on the purchase price of goods sold to the defendant, that the defendant is a resident of this State, to wit, of Carden City, Nassau county, but cannot, after due diligence, be found within the State.
