Appeal from a district court judgment of conviction.

On September 2,1965, an information was filed in the District Court of St. Louis County charging defendant with aggravated assault, contrary to Minn. St. 609.225, subd. 2. Defendant’s first trial resulted in a jury verdict of guilty, but a new trial was granted. At the second trial another jury verdict of guilty was returned, and judgment was entered pursuant thereto on April 21,1966.
