The defendant was convicted of having committed rape upon his daughter Mary, aged 13 years, and sentenced to imprisonment for life. A motion for a new trial was made, and denied. The only assignment of error is predicated upon the denial of this motion. It was based upon an affidavit of the little girl, in Which she stated that her testimony as a witness on the trial was false; that her father had never had sexual intercourse with her. A somewhat extended reference to the proof submitted on the trial and the events following the conviction seems necessary.
