In an action to recover damages for personal injuries, the defendant Fisher Knickerbocker, LLC, appeals from an order of the Supreme Court, Kings County (Partnow, J.), dated Septem*429ber 22, 2004, which denied its motion for summary judgment dismissing the complaint and cross claims insofar as asserted against it.

Ordered that the order is reversed, on the law, with one bill of costs, the complaint and all cross claims are dismissed insofar as asserted against the defendant Fisher Knickerbocker, LLC, and the action against the remaining defendant is severed.
