This is an action brought by George F. Sullivan against the defendant to recover damages for alleged malpractice and for an assault predicated upon the theory that the defendant anaesthetized the plaintiff without his consent or that of his parents. Joseph E. Sullivan, the father of the said George F. Sullivan, asserts *449a claim for loss of earnings, services and medical expenses incurred by him as the result of the alleged malpractice and assault. The defendant is a duly licensed and practicing physician, with an office in the borough of Bronx, New York city.
