Plaintiff, John Swensen, was engaged in the business of designing, building, and selling-monuments and other cemetery memorials. In 1940 he employed defendant as a salesman and agreed to-pay him a commission of 20% on gross sales, based upon list prices furnished by plaintiff. Defendant’s*, right to receive full commission was contingent upon his collecting the purchase price of stones and monuments sold by him.
