In a taxpayer’s action for a declaratory judgment to invalidate an amendment to the Zoning Resolution of the City of New York and for injunctive relief, the *777defendant Sylvania Electric Products, Inc., and the municipal authorities named defendants in the action, have separately moved for summary judgment, pursuant to rule 113 of the Rules of Civil Practice, dismissing the complaint upon the merits. By cross motion, the plaintiffs have likewise moved for summary judgment, hut for the relief prayed for in the complaint.
