KORMAN, District Judge:
On the afternoon of October 15, 2003, the Staten Island Ferry, Andreiv J. Barben, allided with a maintenance pier near the Staten Island Ferry Terminal, killing eleven passengers and injuring more than seventy. When the allision took place, the Dorothy J, a tugboat owned and operated by Henry Marine Service, Inc. (“Henry Marine”), was docked at the same maintenance pier the Barberi hit.
