Appeal from a judgment of the County Court of Chemung County (Buckley, J.), rendered April 30, 2001, convicting defendant upon his plea of guilty of the crime of attempted promoting prison contraband in the first degree.

As a result of an incident in which defendant stabbed another inmate, he was indicted on a single count of promoting prison contraband in the first degree for possessing a 9V2-inch metal rod sharpened to a point.
