Plaintiff Michael Buccieri filed this personal injury action against Illinois Central Gulf Railroad (IC) pursuant to the Federal Employers’ Liability Act (FELA) (45 U.S.C. §§51 through 60 (1988)). Plaintiff alleged that he was a railroad “employee” of IC at the time of his injury and, accordingly, came within the protections of FELA. Plaintiff and IC filed cross-motions for summary judgment on the issue of plaintiff’s “employee” status, and the circuit court of Cook County granted IC’s motion.
