Appeal from an order of the Suprerae Court, Erie County (Rose H. Sconiers, J.), entered October 12, 2006 in a personal *1433injury action. The order, insofar as appealed from, granted plaintiff’s cross motion for partial summary judgment on liability.
It is hereby ordered that the order so appealed from be and the same hereby is unanimously affirmed without costs.
