In a proceeding pursuant to CPLR article 78 to review a determination of the Green Haven Temporary Release Committee which denied the petitioner’s application for temporary release from the Green Haven Correctional Facility, the appeal is from a judgment of the Supreme Court, Dutchess County (Nastasi, J.), entered May 12, 1988, which granted the petition.
Ordered that the judgment is reversed, on the law, without costs or disbursements, and the proceeding is dismissed.
