— This is an action to recover for insurance effected by the plaintiff with the defendants, c< for account of whom it may concern — loss, if any, payable to him,” to the' amount of five thousand dollars, upon freight valued at the sum insured, carried or not carried, for twelve calendar months, on board the propeller General Warren; and the policy provides that the policy shall be proof of interest, and “ in case of loss, such loss to be paid in thirty days after the proof of loss and proof of interest, and adjustment exhibited to the insurers.” The complaint sets out these facts, stating the…
