MOTION in Supreme Court.

This is a motion to have the costs and disbursements consequent upon the reversal of the judgment of the circuit court herein, paid out of the estate. We think the motion should he granted. There are certainly no peculiar circumstances about this case which require the contestant to pay the costs. He had probable cause for contesting the validity of the will, and seems to have acted in good faith in the matter. It would, therefore, appear to be in accordance with the ordinary principles of justice, and likewise in harmony with the practice in cases of this character, to order that the costs…
