The appellant was indicted, tried and convicted of the offense of assault with intent to murder. He was sentenced to serve a term of ten years in the penitentiary, with the last four years of said sentence to be probated. A motion for new trial was filed but was dismissed for want of prosecution. Thereafter, notice of appeal from the judgment of conviction and sentence was filed, and extensions of time for preparation of the record were obtained.
