Klein, P. J.,

Serena Roth, also known as Serena Pataky, testatrix, divided her estate among her three daughters and four grandchildren. Her son, Andrew Pataky, who received no benefits under her will, has appealed from its probate. He contends in his petition that his mother “wrote a last will and testament shortly prior to her death, which said will contained an expression specifically cancelling the said prior will of November 14, 1953, which was probated with the Register of Wills on May 27, 1957.”
