KRUEGER, Judge.
The conviction is for an assault with intent to murder. The-punishment assessed is confinement in the State penitentiary for a term of two years.
Appellant presents three questions for review. The first relates to the court’s action in declining to peremptorily instruct the jury to acquit him.
