This labyrinthine proceeding revolves around a relatively minor work by the Austrian artist Egon Schiele (the “Drawing”). In 2005, Plaintiff David Bakalar (“Bakalar”) filed a declaratory judgment action against Defendants Milos Vavra (“Vavra”) and Leon Fischer (“Fischer”), seeking a ruling that he is the lawful owner of the Drawing. Vavra and Fischer counterclaimed for conversion and replevin.
