— Appeal from a *1331judgment of the County Court of Rensselaer County (Jacon, J.), rendered March 22, 2011, convicting defendant upon his plea of guilty of the crime of burglary in the second degree.

Defendant waived indictment and agreed to be prosecuted by a superior court information charging him with burglary in the second degree. He pleaded guilty to this crime and waived his right to appeal. The terms of the plea agreement included a requirement that defendant pay restitution to the three crime victims in amounts to be determined prior to sentencing.
