TIREY, Justice.

Plaintiff brought this suit for divorce and custody of three minor children and for partition of property. Mrs. Couch answered and filed cross-action for similar relief and for alimony and attorneys’ fees. The cause was tried without the aid of a jury and at the conclusion of the evidence the court took the matter under advisement. In the judgment we find this recital: “Thereafter, before the decision of the Court had been announced, the plaintiff took a non-suit, moving the Court to dismiss his cause at plaintiff’s cost.
