At the time of, and prior to, the events giving rise to this controversy, Troy Brooks was engaged, either in his individual capacity or as a member of a three-man partnership, in the business of removing old telephone equipment, including telephone poles. The Western Casualty and Surety Company issued its policy covering liability resulting from the business of “tearing down telephone lines and poles”. The policy listed the named insured as “Troy Brooks, D. A. Weichold and R. L. Parker, DBA B. P. & W. Construction Co.”. The effective date of the policy was…
