This is a workers’ compensation case. After trial, the Workers’ Compensation Judge (“WCJ”) found that the employee, Sidney Hutchison, sustained an on the job injury which aggravated a preexisting back injury. The WCJ then found the employee entitled to reinstatement of temporary total disability benefits and payment of all medical and transportation expenses. The WCJ also found that the employer, Aldworth Company, Inc. “(Aid-worth”), had been arbitrary and capricious and accordingly, awarded the employee statutory penalties and attorney fees. The…
