Mrs. Emma Hedda Turley, née Burgemeister, joined pro forma by her husband, brought this suit against John W. Tobin, the sureties on his bond as sheriff of Bexar county, and against Bexar county, to recover $■7,500 deposited by her with said To-bin while sheriff of said county as security to her bail bond. Judgment was rendered for the defendants, from which this appeal is prosecuted.
