It is to be observed, in the first place, that no point is made by appellees with reference to the validity of the deed of trust from Robert W. Meacham and wife to Follansbee, or with reference to the genuineness of the claim secured by it. The good faith of that transaction does not, so far as the evidence is concerned, seem to be in any manner questioned. Indeed, the decree of the circuit court recognizes the fact that this deed of trust was a prior valid incumbrance on the lots in controversy.
