CAVANAUGH, Judge.
Plaintiff as subrogee of its insured paid the sum of $1,264.37, which payment it alleges represented the cost of repair and towing charges on an automobile of Mrs. L. A. Domingue on which it had issued a collision insurance policy and which automobile was negligently driven by the defendant on March 27, 1951, causing it to go off of the highway, overturning and resulting in the damage which plaintiff had paid.
