MEMORANDUM OPINION AND ORDER

FINESILVER, Judge.

In this action brought pursuant to 42 U.S.C. § 1983, Plaintiff seeks a declaratory judgment holding unconstitutional a Colorado statute requiring that students at state universities be domiciled in Colorado for at least one year before receiving in-state tuition status. Plaintiff also requests injunctive relief certifying him as an in-state student. A three judge District Court was convened pursuant to 28 U.S.C. §§ 2281 and 2284 (1970).
