This suit is upon a bond executed by the defendants under the insolvent laws of this state, conditioned that the defendant, Mattix, would appear and apply for the benefit of the insolvent laws of this state, and if he was refused his discharge as an insolvent debtor, that he would surrender himself to the custody of the sheriff of the county of Atlantic.
