Since this appeal has been pending in this court, Edward A. O’Neal, Jr., has died. The claim which they seek to enforce is a partnership demand, and it is now the property of Edward A. O’Neal, surviving partner. The case will be continued in his name as appellee.
The complainants below make out a clear case for relief, unless it is shown that the money, with which the lots were purchased, was the separate estate of Mrs. McAnally. ¥e say they make out a clear case, because they aver and prove that they were creditors of Patrick McAnally, the husband, before the money was recovered…
