Ernestina Rodriguez was convicted and sentenced to life in prison for the capital murder of her seventy-four day old child, Ramiro, by intentionally or knowingly starving him. On appeal, Rodriguez contends her trial counsel’s deficient performance substantially prejudiced her in violation of the right to effective assistance of counsel guaranteed by the Sixth and Fourteenth Amendments to the United States Constitution and article I, section 10 of the Texas Constitution. 1 However, the record remains silent as to the extent of trial counsel’s investigation…
