Appeal by the defendant, James Nash Webb, as executor, etc., from a judgment of the Supreme Court in favor of the plaintiff, entered in the office of the clerk of the county of New York on the 6th day of April, 1914, upon the report of a referee appointed to hear and determine the issues.

This action is brought to recover for services rendered and expenses incurred by the plaintiff under two instruments of trust executed to the plaintiff ás trustee by the testator of the defendant.
The first trust instrument was executed on the 23d day of April, 1896, whereby William Gr. Wood, the defendant’s testator, assigned to the plaintiff various claims enumerated and specified in the schedule annexed to the instrument.
