Snyder, Judge:
Action of tresspass on the case brought in the circuit court of Marshal county by Simeon Johnson against the Baltimore and Ohio Railroad Company to recover damages for the killing of two horses by the defendant. There was a verdict for the plaintiff for $385.00 on which the court entered judgment July 5, 1882. During the trial the defendant ex*572cepted to certain rulings of the court and to review those rulings obtained this writ of error.
