delivered the opinion of the Court.

Plaintiff in error was fined $250 by the judgment of the Circuit Court for alleged contempt of court, to reverse which judgment this writ of error was sued out.

June 25, 1897, the following affidavit was filed in the lower court:

“William Elmore Foster, being duly sworn, deposes and says: That he is the assistant attorney of the Lake Shore & Michigan Southern Railway Company; that he was present at the trial of the case of H. A. Foster, Adm’r of the estate of George Gierz, deceased, v. the said company, on the 17th day of June, A. D.…
