The petitioner herein, Harlen Broyles, was charged in the superior court of Seminole county with the crime of murdering Eric Nicholson, a deputy sheriff of Seminole county, in the city of Seminole, on January 10, 1945. He was tried, convicted, and sentenced to be executed. He appealed his case to this court, and the judgment and sentence was affirmed on October 3, 1946, and the date of his execution was set for December 31, 1946.
