The point presented by this submission relates to the construction of the will of Oliver H. Payne, who died on the 27th of June, 1917, and whose will was duly admitted to *132probate by a surrogate of New York county on the 16th of August, 1917. The submission does not show when the will was executed, but it appears that the testator maintained a country house in "Ulster county and a town house known as No. 582 Fifth avenue, in the borough of Manhattan, New York.
