Pending before the Court are cross:motions for summary judgment from the plaintiffs, a group of hospitals owned by Community Health Systems, Inc. (“CHS”), Pis.’ Mot. Summ. J. (“Pis.’ Mot.”), ECF No. 15-1, and the defendant, the Secretary of Health and Human Services (“HHS”), who is sued in her official capacity, Def.’s Mot. Summ. J.
