Appeal from a judgment of death pronounced against the defendant upon a conviction for murder in the first degree, and also from an order made subsequent to the judgment. The assignments of error are that the court exceeded its jurisdiction in making the order appealed from, and that it misdirected the jury by .the following instructions, namely:— “1. You can find defendant guilty of murder in the first degree, or guilty of murder in the second degree, or guilty of manslaughter, or you may render a verdict of not guilty; and it is for you to decide which one of those verdicts you may render;…
