This is a paternity action commenced by the State of Nebraska pursuant to Neb. Rev. Stat. § 43-512.03 (Reissue 1998). Albert Porter appeals from an order of the district court for Seward County, Nebraska, which determined that he was the father of Z.P., born November 3, 1997, and required that he pay child support in the amount of $356 per month commencing on September 1, 1998. Porter, who was incarcerated when this action was filed and tried, does not contest paternity but contends that the district court erred in determining his earning capacity for purposes of calculating his child support…
