The problem with this case is that it is too simple. All that is involved is a statute which has been declared unconstitutional, a constitutional provision which requires this Court to declare the unconstitutional statute void, and a statute which says taxes erroneously or illegally collected must be refunded. This case involves the state’s illegal collection of taxes from a single, readily-identifiable party on the basis of an unconstitutional statute.
