OPINION

RODRIGUEZ, Justice.

Kurt Obersteller, a Flour Bluff High School student, and his parents, filed suit against the Flour Bluff Independent School District (FBISD) and Ronnie Newman, Head Coach and Athletic Director for the FBISD.

The original petition asserted tort claims based on state law as well as federal claims based on 42 U.S.C. § 1983. The case was removed to federal court which issued final judgment in favor of defendants on the federal claims but declined to exercise supplemental jurisdiction over the state law tort claims.
