Proceeding pursuant to CPLR article 78 (transferred to this court by order of the Supreme Court at Special Term, entered in St. Lawrence County) to review a determination of the superintendent of highways, which dismissed petitioner after a hearing. Petitioner Grow, continually employed by the respondent county since 1958, was appointed assistant civil engineer in the highway department on February 7, 1970. This was a civil service position.
