Order, Supreme Court, New York County, entered June 20, 1975, granting plaintiff’s motion for an order setting aside the jury’s verdict in favor of the defendant, and remanding for a new trial, unanimously affirmed, with $60 costs and disbursements of this appeal to respondent. The decedent, seemingly annoyed because his passenger friend, the plaintiff, was late in arriving at the car, lost control of his automobile and crashed, killing himself and injuring the plaintiff.
