William M. Adams brought a petition to enjoin the sale of certain described property under a judgment and execution for auditor’s fees of Frank T. Grizzard, pending an application for a homestead in the ordinary’s court. The petition alleged substantially the following: Frank T. Grizzard has placed in the hands of the sheriff, B. W. Adams, an execution in his favor against petitioner, on a judgment rendered in his favor for auditor’s fees on or about February 11, 1930, amounting to $400, and caused the execution to be levied upon certain property described, which is being advertised for sale…
