In this case I find myself constrained to dissent from my brothers in their conclusions of fact as well as of law, and my reasons are as follows:
On July 20, 1893, appellees instituted this suit to recover against appellant upon the following note:
"$857.50. Henrietta, Texas, May 20, 1892.
"Six months after date, I, we, or either of us, promise to pay to the order of Worsham, Davidson, Featherston and Easley, at Citizens' Bank, eight hundred fifty-seven and 50-100 dollars, with interest at the rate of ten per cent per annum from date until paid, and ten per cent additional for attorney's fees,…
