This case has been submitted to the court on the Joint Stipulation of Facts and supporting evidence, Filing No. 45; affida vits, Filing Nos. 46, 47, 48 and 50; and the trial briefs of the parties, Filing Nos. 65, 66 and 67. This is an action for declaratory and injunctive relief for deprivation of constitutional rights brought pursuant to 42 U.S.C. § 1983.
